1. Overview
IPTV Cyprus respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others. This policy outlines our procedures for addressing copyright infringement claims.
2. Copyright Compliance
We are committed to complying with copyright law and responding to claims of copyright infringement. We operate as a service provider and do not host, store, or control the content streams available through our service. We work with licensed content providers and aggregators. Users are prohibited from using our service to access, distribute, or share copyrighted material without proper authorization. We take appropriate action when notified of alleged infringement.
3. Infringement Notification Process
If you believe that your copyrighted work has been infringed, please provide our designated DMCA agent with a written notice containing: (1) A physical or electronic signature of the copyright owner or authorized representative. (2) Identification of the copyrighted work claimed to have been infringed. (3) Identification of the material that is claimed to be infringing and information to locate it. (4) Your contact information including address, telephone number, and email. (5) A statement that you have a good faith belief that the use is not authorized. (6) A statement under penalty of perjury that the information is accurate and you are authorized to act.
4. Counter-Notification Process
If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification containing: (1) Your physical or electronic signature. (2) Identification of the material that was removed and its location before removal. (3) A statement under penalty of perjury that you have a good faith belief the material was removed by mistake. (4) Your name, address, telephone number, and a statement consenting to jurisdiction. (5) A statement that you will accept service of process from the complaining party. Upon receipt of a valid counter-notification, we may restore the material after 10-14 business days unless the copyright owner files legal action.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. We maintain records of DMCA notices and may use them to identify repeat offenders.
6. Safe Harbor Provisions
IPTV Cyprus operates as a service provider under the safe harbor provisions of the DMCA. We do not actively monitor or control the content accessible through our service. We respond promptly to valid DMCA notices. We do not have direct control over third-party content sources. Our role is limited to providing access infrastructure. We take reasonable steps to prevent known infringement. We cooperate fully with copyright holders and legal authorities in addressing infringement claims.
7. Good Faith Requirement
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or blocked by mistake may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in bad faith or with malicious intent. False claims may result in legal consequences including monetary damages and attorney fees.
8. Processing Time
Upon receipt of a valid DMCA notice, we will: Acknowledge receipt within 24-48 hours. Investigate the claim and take appropriate action. Remove or disable access to allegedly infringing material if the claim is valid. Notify the affected user of the takedown. Process counter-notifications within 10-14 business days. We strive to handle all DMCA matters promptly and professionally while respecting the rights of all parties involved.
